THE COURT SAID NO. THE NAMES MATTER.

Nine justices. Five dissenters. One absence. That's the math behind the Supreme Court's May 20 decision to deny Senator Ronald "Bato" dela Rosa a temporary restraining order against his ICC arrest warrant.

The vote is public now. And the names tell a story worth reading carefully.

WHO VOTED AGAINST THE TRO

The nine justices who denied Bato's plea: Chief Justice Alexander Gesmundo, Senior Associate Justice Marvic Leonen, and Associate Justices Alfredo Benjamin Caguioa, Rodil Zalameda, Samuel Gaerlan, Jhosep Lopez, Jose Midas Marquez, Maria Filomena Singh, and Raul Villanueva.

Here's the detail that cuts through the political noise: six of those nine — Gesmundo, Zalameda, Gaerlan, Lopez, Marquez, and Singh — are Duterte appointees.

Six justices appointed by the man whose drug war is the very subject of the ICC investigation voted against giving his former police chief a temporary escape hatch.

The remaining three — Leonen and Caguioa, both Aquino appointees, and Villanueva, a Marcos appointee — also voted against the TRO.

WHO TRIED TO GIVE BATO THE SHIELD

The five justices who voted to grant the TRO: Associate Justices Ramon Paul Hernando, Amy Lazaro-Javier, Henri Jean Paul Inting, Ricardo Rosario, and Antonio Kho Jr.

All five are Duterte appointees.

Associate Justice Japar Dimaampao — also a Duterte appointee — was on official leave when the vote was taken. His absence was not a principled abstention. He simply wasn't there.

So the bloc that wanted to protect Bato was entirely composed of Duterte appointees. The bloc that outvoted them included a majority of Duterte appointees who apparently decided the law was the law.

WHAT THE COURT ACTUALLY SAID

The ruling was narrow on purpose.

The SC was clear: it only decided on the prayer for interim relief.

The main questions — whether the ICC warrant is enforceable on Philippine soil, whether the Philippines still has treaty obligations after withdrawing from the Rome Statute, whether R.A. 9851 covers this — those are all still open.

What the Court said, in simple terms, was this: Bato has no clear and unmistakable right to be protected. There is no material and substantial invasion of his rights that warrants stopping the warrant's enforcement. The TRO is denied for lack of merit.

That's the SC saying: we're not your personal restraining order service.

NOW COMPARE THAT TO JULY 2025

The same Court, in July 2025, voted to block Sara Duterte's first impeachment.

The decision was penned by Senior Associate Justice Leonen himself — the same Leonen who just voted to deny Bato's TRO.

All participating justices concurred. None dissented.

Caguioa took no part, listed as on official business. Singh was on leave.

Unanimous among those present. Not a single recorded objection.

That ruling rested on the constitutional one-year bar on impeachment — that the House cannot transmit a second set of articles of impeachment within one year of the first. Technically sound. Legally defensible. And deeply convenient for the Duterte camp.

The Court affirmed that decision with finality in January 2026, when the House appealed. Again, no dissent.

Leonen wrote the opinion that protected Sara. Leonen also voted against protecting Bato. The same man. Different cases. Different results.

THE SARA IMPEACHMENT ANGLE

The reason people are drawing a line between Bato's case and Sara's trial isn't because the legal arguments are identical. They're not.

It's because the political family is the same.

Sara Duterte's impeachment trial opened in the Senate on May 17. The charges include the alleged misuse of P612.5 million in confidential funds, and alleged conspiracy to assassinate President Marcos, First Lady Liza Araneta-Marcos, and House Speaker Martin Romualdez.

The Senate math is grim for accountability advocates.

Conviction requires two-thirds of the Senate sitting as an impeachment court.

The pro-Duterte bloc — whose senators orchestrated a leadership coup on May 13 that ousted Senate President Tito Sotto and installed Alan Peter Cayetano — holds enough seats to block that threshold.

The Supreme Court cannot fix that. And the Bato TRO denial, while significant, doesn't touch what happens in that chamber.

THE REAL QUESTION LEFT UNANSWERED

With the TRO gone, Solicitor General Darlene Marie Berberabe declared publicly that there is no legal basis to stop the enforcement of the ICC arrest warrant against Bato.

The question is no longer whether Bato can be arrested. The question is whether the Marcos administration wants to arrest him.

The DOJ's general posture has been to wait for legal issues to resolve before acting. The Palace said the warrant is valid. Then silence. Then the Court removed the obstacle. Then more silence.

Bato is still hiding.

The Court did its part. The executive branch is still deciding whether it wants to do its.
